Purpose and acceptance

These terms govern the use of GiftMeThis (the mobile app, the giftmethis.app website and related services), owned by Juan José Díaz Rodríguez (NIF 74733599K). By creating an account or using the service you accept these terms; if you do not agree, do not use it.

GiftMeThis lets you create gift lists for children, share them with family through a private link, and have each relative reserve a gift without the parents knowing who reserved it.

Registration and account

• To create and manage lists you need an account, which must be opened by an adult. The account is personal and you are responsible for keeping your sign-in method secure.
• You must provide truthful information and keep it up to date.
• Relatives and friends do not need an account: the private link to the list is enough. Anyone with the link can see the list and reserve gifts, so share it only with the people you want. You can revoke or regenerate it at any time from the app.

User content and licence

You are responsible for the content you enter (names, nicknames, notes, links and gift images) and you declare that you have the right to use it. It remains yours.

You grant us a free, non-exclusive and limited licence to store, technically adapt (for example resize images and clean links) and display that content to the people you share the list with, solely to provide the service. The licence ends when you delete the content or the account, without prejudice to the retention periods in the Privacy policy.

For the safety of minors, do not upload photos of children or data that identifies them: the app uses nicknames and predefined avatars.

Prohibited content, reports and moderation

You may not use GiftMeThis to:

• publish content that is illegal, offensive, discriminatory, violent, sexual or that infringes third-party rights, including intellectual property and image rights;
• send spam, make unsolicited advertising or try to defraud other people;
• impersonate another person, or collect data about other users;
• try to access the service without authorisation, interfere with its operation or bypass its security measures.

Anyone who sees a list or a gift can report it with the Report button. We review reports and, where appropriate, we may hide a gift, suspend an event or block an account. Whenever possible, we will notify the person concerned in the app, with the reason. You can reply to us at support@giftmethis.app if you think it was a mistake.

Purchase links and affiliation

When you save a gift with a store link, you agree that GiftMeThis may normalise that link: we may clean it (for example remove tracking parameters) and, for stores where we have an affiliate programme such as Amazon, replace or add our affiliate ID. We also keep the original link.

If the link already includes another person’s affiliate ID, we will ask you before replacing it; if you do not allow it, the original link is used unchanged.

The price for the buyer is the same, and GiftMeThis may earn a commission from the store on qualifying purchases. This is how the service is funded and can be free. More information in the Affiliate disclosure.

Once you leave GiftMeThis for a store, the purchase is a contract between you and the store. GiftMeThis does not sell products, takes no part in payment or delivery, and is not responsible for the prices, availability or quality of what is sold.

Free of charge

Using GiftMeThis is free. If paid features were offered in the future, this would be clearly stated before any charge and would not affect what you already use for free without your consent.

Account deletion

You can delete your account at any time from the app (Settings, Delete account) or by requesting it from the Delete my account page. Your account is left pending deletion and you have 30 days to restore it by signing up again with the same email. After that period, all your data is permanently deleted, as detailed in the Privacy policy.

Relatives can cancel their reservation at any time from their private link.

We may suspend or cancel an account that breaches these terms, with prior notice whenever possible.

Limitation of liability

GiftMeThis is provided as is, with no guarantee of continuous availability or of being error-free. To the extent permitted by law, the owner is not liable for damage arising from service interruptions, third-party content, purchases made in external stores, or misuse of a list’s private link by whoever received it.

Nothing above limits the rights that the law grants to consumers or liability that cannot be excluded by law.

Changes

We may change these terms, for example because of changes to the service or the law. We will show the date of the last update above and, if the change is important, we will notify you in the app or by email in reasonable advance. If you keep using the service afterwards, we understand that you accept the new version; if you disagree, you can delete your account.

Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute, the parties submit to the courts that are competent under the applicable rules; if you are a consumer, those of your place of residence.
